Мне до сих пор не выплатили полный расчет при увольнении. Выплатили остаток зарплаты, а компенсацию за неотгуленный отпуск не выплатили, хотя обещали. Уже прошло больше месяца. Что делать? 

При увольнении работодатель обязан выплатить все причитающиеся работнику деньги в день увольнения. Такое правило закреплено в 140 статье Трудового Кодекса. Обратите внимание, что данная статья регламентирует выплату день в день неоспариваемой суммы.

При прекращении трудового договора выплата всех сумм, причитающихся работнику от работодателя, производится в день увольнения работника.

Если работник в день увольнения не работал, то суммы должны быть выплачены не позднее следующего дня после предъявления уволенным работником требования о расчете.

В случае спора о размерах сумм, причитающихся работнику при увольнении, работодатель обязан в указанный срок выплатить не оспариваемую им сумму.

При увольнении работнику полагается: 

1. Остаток зарплаты за отработанное время.
2. Выплата премий, бонусов, надбавок и доплат.
3. Компенсация за неиспользованный отпуск.

К сожалению, нередки случаи, когда работодатель нарушает свои обязанности по соблюдению законодательства в части выплаты причитающихся работнику средств. Однако у работника есть законное право требовать полагающиеся ему деньги.

Таким образом, вы можете: 

• обратиться письменно к работодателю
• обратиться с жалобой в трудовую инспекцию
• написать заявление в прокуратуру
• взыскать долг через суд

Начать следует с письменного требования работодателю. Возможно, вам удастся урегулировать задолженность на этом этапе. В этом же требовании заявите работодателю, что вы будете вынуждены обратиться в трудовую инспекцию за защитой своих прав. Также напомните работодателю, что несвоевременная выплата грозит штрафом, который назначит сотрудник Трудовой инспекции в рамках проверки организации по жалобе сотрудника.

Невыплата или неполная выплата в установленный срок заработной платы влечет предупреждение или наложение административного штрафа:

• на должностных лиц в размере от 10 тыс. до 20 тыс. рублей;
• на индивидуальных предпринимателей — от 1 тыс. до 5 тыс. рублей;
• на юридических лиц — от 30 тыс. до 50 тыс. рублей.

Если ваши трудовые права нарушаются, вы можете пожаловаться в Трудовую инспекцию самостоятельно или с помощью консультантов.
