Я написал заявление на увольнение по собственному желанию, а начальник его не принимает и не подписывает. Что мне делать? Как мне уволиться?
Ваш начальник поступает незаконно. Работа — это не от слова «раб». Работодатель не имеет права насильно удерживать работника более двух недель, такая норма прописана в Трудовом Кодексе. Порядок действий регламентирован статьей 80 ТК РФ.
Работник имеет право расторгнуть трудовой договор, предупредив об этом работодателя в письменной форме не позднее чем за две недели, если иной срок не установлен настоящим Кодексом или иным федеральным законом.
Течение указанного срока начинается на следующий день после получения работодателем заявления работника об увольнении.
По истечении срока предупреждения об увольнении работник имеет право прекратить работу.
В последний день работы работодатель обязан выдать работнику трудовую книжку или предоставить сведения о трудовой деятельности, выдать другие документы, связанные с работой, по письменному заявлению работника и произвести с ним окончательный расчет.
Согласно норме Трудового законодательства, согласия работодателя на увольнение работника по собственному желанию не требуется.
Важно! Ваше заявление об увольнении по собственному желанию должно быть официально принято. Если руководитель не принимает заявления, то оно может быть вручено иному представителю работодателя под роспись (передано в отдел кадров или секретариат) или даже отправлено по почте заказным письмом.
Обратите внимание, что ваше бездействие, последовавшее за бездействием работодателя, сводит на нет ваше желание уволиться. Работодатель как-бы «не заметил» вашего заявления на увольнение по собственному желанию, и все осталось, как и было. Вы имеете законное право не выходить на работу через две недели, а работодатель обязан с вами рассчитаться в ваш последний рабочий день согласно вашему заявлению. Если же вы продолжаете работать, значит, вас всё устраивает.
Если по истечении срока предупреждения об увольнении трудовой договор не был расторгнут и работник не настаивает на увольнении, то действие трудового договора продолжается.
Если ваши трудовые права нарушаются, то вы можете пожаловаться в Государственную инспекцию труда самостоятельно или с помощью консультантов.
