На нашем предприятии регулярно задерживают зарплату на две — три недели. Начальство пользуется нашими деньгами, а мы вынуждены брать кредиты до зарплаты. Как законно можно получить компенсацию за задержку зарплаты?
Работодатель не имеет права задерживать выплату зарплаты. Ни одна причина не может быть уважительной, в том числе отсутствие денег у предприятия.
Сроки выплаты зарплаты
Выплата зарплаты должна быть два раза в месяц, соответствующая норма содержится в Трудовом кодексе.
Трудовой Кодекс РФ. Статья 136. Порядок, место и сроки выплаты заработной платы (оригинал документа).
Заработная плата выплачивается не реже чем каждые полмесяца. Конкретная дата выплаты заработной платы устанавливается правилами внутреннего трудового распорядка или трудовым договором не позднее 15 календарных дней со дня окончания периода, за который она начислена.
При совпадении дня выплаты с выходным или нерабочим праздничным днем выплата заработной платы производится накануне этого дня.
Оплата отпуска производится не позднее чем за три дня до его начала.
Компенсация работнику за задержку зарплаты
За задержку выплаты зарплаты по любым причинам работодатель обязан выплатить работнику проценты (денежную компенсацию).
При нарушении работодателем срока выплаты зарплаты, оплаты отпуска, выплат при увольнении или других выплат работнику, работодатель обязан выплатить их с уплатой процентов в размере не ниже одной сто пятидесятой ключевой ставки ЦБ РФ от не выплаченных в срок сумм за каждый день задержки начиная со следующего дня после срока выплаты по день фактического расчета включительно.
При неполной выплате в срок зарплаты или других выплат работнику, размер процентов исчисляется из фактически не выплаченных в срок сумм.
Размер выплачиваемой работнику денежной компенсации может быть повышен коллективным или трудовым договором.
Обязанность по выплате указанной денежной компенсации возникает независимо от наличия вины работодателя.
Работник имеет право не работать
Если зарплата задерживается более 15 дней, работник имеет право приостановить свою работу на весь период задержки, письменно уведомив об этом работодателя.
Работодатель или представители работодателя, допустившие задержку выплаты работникам заработной платы и другие нарушения оплаты труда, несут ответственность.
В случае задержки выплаты зарплаты на срок более 15 дней работник имеет право, известив работодателя в письменной форме, приостановить работу на весь период до выплаты задержанной суммы.
В период приостановления работы работник имеет право в свое рабочее время отсутствовать на рабочем месте.
На период приостановления работы за работником сохраняется средний заработок.
Работник обязан выйти на работу после получения письменного уведомления от работодателя о готовности произвести выплату задержанной зарплаты в день выхода работника на работу.
К сожалению, нередки случаи, когда работодатель нарушает свои обязанности по соблюдению законодательства в части выплаты причитающихся работнику средств. Однако у работника есть законное право требовать полагающиеся ему деньги.

Способами защиты трудовых прав и свобод являются:
- самозащита работниками трудовых прав
- защита трудовых прав работников профессиональными союзами
- государственный контроль за соблюдением трудового законодательства
- судебная защита
Таким образом, вы можете:
- обратиться письменно к работодателю
- обратиться с жалобой в трудовую инспекцию
- написать заявление в прокуратуру
- взыскать долг через суд
Начать следует с письменного требования работодателю. Возможно, вам удастся урегулировать задолженность на этом этапе. В этом же требовании заявите работодателю, что вы будете вынуждены обратиться в трудовую инспекцию за защитой своих прав. Также напомните работодателю, что несвоевременная выплата грозит штрафом, который назначит сотрудник Трудовой инспекции в рамках проверки организации по жалобе сотрудника.
