Я работаю в маленькой компании. Со мной заключили трудовой договор и говорят, что платят налоги. Но я сомневаюсь, что оформлена официально. Как проверить, чтобы быть уверенной на 100%, что моя работа — легальная, и у меня идет пенсионный стаж?
Если с вами заключили трудовой договор — это первый сигнал, что вы официально трудоустроены. Наличие трудового договора означает, что вы находитесь в трудовых отношениях с работодателем. Один экземпляр подписанного трудового договора передается работнику, другой хранится у работодателя (статья 67 ТК РФ).
Согласно Трудовому кодексу работодатель также должен оформить приказ о вашем выходе на работу.

Прием на работу оформляется приказом работодателя, изданным на основании заключенного трудового договора. Содержание приказа должно соответствовать условиям заключенного трудового договора.
Приказ работодателя о приеме на работу объявляется работнику под роспись в трехдневный срок со дня начала работы. По требованию работника работодатель обязан выдать ему копию приказа.
Также подтвердить ваше официальное оформление могут документы: трудовая книжка с записью о приеме на работу, табеля учета рабочего времени, расчетные листки, ведомости и другие платежные документы о выплате заработной платы, справки, выдаваемые работодателем (о размере зарплаты, о задолженности по зарплате).
Подтверждение трудового стажа
Работодатель обязан вести учет трудового стажа работника. Трудовой стаж влияет на формирование будущей пенсии. Согласно 66 статье ТК РФ трудовая книжка установленного образца является основным документом о трудовой деятельности и трудовом стаже работника. С 2020 года идет замена бумажных трудовых книжек на электронные трудовые книжки.
Также согласно статье 66.1 ТК РФ работодатель формирует в электронном виде основную информацию о трудовой деятельности и трудовом стаже каждого работника и представляет ее для хранения в информационных ресурсах Пенсионного фонда РФ.
Через портал Госуслуги можно получить Выписку из электронной трудовой книжки. Электронная услуга называется «Предоставление сведений о трудовой деятельности зарегистрированного лица, содержащихся в его индивидуальном лицевом счете». Указанную услугу можно получить в личном кабинете на официальном сайте Госуслуги или на официальном сайте Пенсионного Фонда через личный кабинет.
Налоги — НДФЛ
Проверить, сколько уплачивает работодатель налогов и взносов за каждого сотрудника, можно в личных кабинетах на сайтах Пенсионного фонда и Налоговой службы, либо на сайте Госуслуги в соответствующих разделах.
Налог на доходы физических лиц (НДФЛ) составляет 13 % от дохода физических лиц.
РАЗМЕР НАЛОГА = НАЛОГОВАЯ БАЗА* СТАВКА НАЛОГА
Пример: Сумма зарплаты составляет 100 000 рублей. Сумма НДФЛ = 100 000 рублей * 13 % = 13 000 рублей.
НДФЛ за работника уплачивает налоговый агент — предприятие, где трудится работник. А работник может воспользоваться налоговыми вычетами с уплаченного НДФЛ — на детей, обучение, лечение, покупку квартиры и другими. Поэтому для работника очень важно контролировать сумму НДФЛ. В этом поможет справка 2-НДФЛ — отчет о доходах физического лица и уплаченном НДФЛ.
Работник может запросить в бухгалтерии работодателя справку 2-НДФЛ, либо получить ее в личном кабинете на сайте nalog.ru. В личном кабинете отражается справка за прошлый год. Сведения о доходах попадают в инспекцию до 1 апреля, а в личном кабинете обычно становятся доступны в мае или июне. Если справка понадобилась раньше, ее нужно запросить у работодателя.
Пенсионные взносы
Будущая пенсия каждого работающего гражданина зависит не только трудового стажа, но и от количества пенсионных баллов, накопленных им за период работы. Пенсионные балы формируются из ежемесячных перечислений работодателями взносов в Пенсионный фонд РФ. Сумма взносов зависит от размера заработной платы работника.
Получить Извещение о состоянии лицевого счета в ПФР можно на официальном сайте Пенсионного Фонда через личный кабинет.
