Мы разводимся с женой. После развода она хочет оставить себе мою фамилию. Мне это не нравится. Можно ли запретить бывшей супруге носить фамилию мужа и заставить ее взять обратно свою девичью фамилию?
Вы никак не можете запретить вашей бывшей жене оставить вашу фамилию после развода. Это полностью решение вашей супруги, с какой фамилией ей жить. Юридически повлиять на ее выбор вы не можете.
Супруга решает, как в браке, так и после прекращения брака — какую ей фамилию выбрать: оставить свою девичью фамилию или взять фамилию мужа.
Статья 32 Семейного Кодекса регулирует права супругов в вопросе выбора фамилии (оригинал документа).
Статья 32 СК РФ. Право выбора супругами фамилии
1. Супруги по своему желанию выбирают при заключении брака фамилию одного из них в качестве общей фамилии, либо каждый из супругов сохраняет свою добрачную фамилию, либо присоединяет к своей фамилии фамилию другого супруга.
2. Перемена фамилии одним из супругов не влечет за собой перемену фамилии другого супруга.
3. В случае расторжения брака супруги вправе сохранить общую фамилию или восстановить свои добрачные фамилии.
Взять фамилию мужа — это право женщины, а не обязанность. Следовательно, такое же право у нее возникает в случае развода: оставить всё как есть или вернуть свою девичью фамилию.
Многие женщины при расторжении брака оставляют фамилию бывшего мужа по двум причинам:
- ради детей, чтобы фамилия матери совпадала с фамилией ребенка
- из-за сложностей при переоформлении документов из-за смены фамилии
Кстати, мужчины тоже могут взять фамилию жены, закон прямо об этом говорит. Но такая ситуация встречается редко.
