На работе мне предложили подработать за временно отсутствующего сотрудника. Размер доплаты не назвали, сказали «по результатам работы». На какой размер доплаты за работу вместо временно отсутствующего работника я могу рассчитывать?
Размер доплаты за работу вместо временно отсутствующего сотрудника определяется по договоренности работника и работодателя. Оговоренная сумма должна быть зафиксирована в дополнительном соглашении к трудовому договору или в приказе работодателя.
Работодатель должен с вами договориться о размере доплаты ДО того, как вы начнете выполнять работу за вашего коллегу. Если вас не устроит предлагаемая работодателем доплата, то вы имеете право отказаться от дополнительной работы. Однако, доплата положена только в том случае, если выполнение этой работы не входит в обязанности работника по трудовому договору.
Трудовой кодекс РФ предусматривает совмещение работ только с согласия работника и только за дополнительную плату. Предусмотрен следующий порядок действий:
- Работодатель в письменной форме должен обозначить фронт работ, а также период, в течение которого работник будет совмещать две должности (или две работы).
- Работник должен дать свое письменное согласие на совмещение должностей. Если работник не давал письменного согласия, то работодатель не имеет права привлечь его к работе по совместительству.
Даже дав согласие, работник может досрочно отказаться от совмещения должностей, предупредив работодателя за три дня.
Эти правила регламентируются Трудовым Кодексом:
С письменного согласия работника ему может быть поручено выполнение наряду с работой, определенной трудовым договором, дополнительной работы по другой или такой же профессии (должности) за дополнительную оплату.
Поручаемая работнику дополнительная работа по другой профессии (должности) может осуществляться путем совмещения профессий (должностей).
Поручаемая работнику дополнительная работа по такой же профессии (должности) может осуществляться путем расширения зон обслуживания, увеличения объема работ.
Для исполнения обязанностей временно отсутствующего работника без освобождения от работы по трудовому договору, работнику может быть поручена дополнительная работа как по другой, так и по такой же профессии (должности).
Срок, в течение которого работник будет выполнять дополнительную работу, ее содержание и объем устанавливаются работодателем с письменного согласия работника.
Работник имеет право досрочно отказаться от выполнения дополнительной работы, а работодатель — досрочно отменить поручение, предупредив об этом в письменной форме не позднее чем за три рабочих дня.
При совмещении профессий (должностей) без освобождения от работы, определенной трудовым договором, работнику производится доплата.
Размер доплаты за работу
Регулирует правила доплаты статья 151 Трудового кодекса. Как уже было сказано, законом не определены критерии и точные расчеты. Размер доплаты за совмещение — это предмет договоренности.
При совмещении профессий (должностей), расширении зон обслуживания, увеличении объема работы или исполнении обязанностей временно отсутствующего работника без освобождения от работы, определенной трудовым договором, работнику производится доплата.
Размер доплаты устанавливается по соглашению сторон трудового договора с учетом содержания и (или) объема дополнительной работы.
