Какие документы работодатель имеет право потребовать при приеме на работу? Законно ли требование предъявить справку об отсутствии судимости и из психдиспансера?
Законом регламентирован список обязательных документов, которые должен предъявить работник при приеме на работу. Дополнительные документы могут потребоваться только в определенных ситуациях. Так, например, при оформлении на работу справку об отсутствии судимости должны представлять не все граждане. Такое требование работодателя обосновано в том случае, если гражданин оформляется на работу, которую нельзя выполнять при наличии судимости. Список предъявляемых документов перечислен в статье 65 Трудового Кодекса РФ.
Основные документы при приеме на работу
При заключении трудового договора лицо, поступающее на работу, предъявляет работодателю:
- паспорт или иной документ, удостоверяющий личность;
- трудовую книжку и/или сведения о трудовой деятельности, за исключением случаев, если трудовой договор заключается впервые;
- документ, подтверждающий регистрацию в системе индивидуального персонифицированного учета;
- документы воинского учета — для военнообязанных и лиц, подлежащих призыву на военную службу;
- документ об образовании, квалификации или наличии специальных знаний — при поступлении на работу, требующую специальных знаний или подготовки;
- справку о наличии (отсутствии) судимости — при поступлении на работу, на которую не допускаются лица, имеющие судимость;
- справку об административном наказании за потребление наркотических средств — при поступлении на работу, где не допускаются лица, подвергнутые административному наказанию за потребление наркотических средств.
Запрещается требовать от лица, поступающего на работу, документы помимо предусмотренных настоящим Кодексом и иными федеральными законами.
Дополнительные документы при приеме на работу
В отдельных случаях при приеме на работу работодатель может потребовать дополнительные документы. Например, согласно статье 283 ТК РФ при приеме на работу по совместительству к другому работодателю на работу с вредными или опасными условиями труда работник обязан предъявить справку о характере и условиях труда по основному месту работы.
Другой пример: заключение трудового договора с лицами, привлекаемыми на работу в районы Крайнего Севера допускается при наличии у них медицинского заключения об отсутствии противопоказаний для работы и проживания в данных местностях (статья 324 ТК РФ).
Документы при приеме на работу для иностранных граждан
При заключении трудового договора с иностранным гражданином помимо основных документов требуются дополнительные документы:
Наряду с документами, предусмотренными статьей 65, при заключении трудового договора поступающий на работу иностранный гражданин предъявляет работодателю:
- договор (полис) добровольного медицинского страхования, действующий на территории РФ,
- разрешение на работу или патент,
- разрешение на временное проживание в РФ или вид на жительство.
Если работодатель требует не предусмотренные законом документы, то такое требование не правомерно.
