Я беременна на третьем месяце. Мой начальник еще не знает, что скоро мне положено уходить в декрет. За сколько дней до ухода в декрет я должна сообщить на работе о своей беременности?
В законах нет четкой информации, в какой срок беременная женщина обязана сообщить руководителю о своем положении. Обратимся к Трудовому кодексу, где прописано, в какие сроки можно уйти в декретный отпуск по закону, а потом обсудим, как лучше предупредить на работе о планируемом декрете.

Женщинам по их заявлению и на основании выданного в установленном порядке листка нетрудоспособности предоставляются отпуска по беременности и родам продолжительностью 70 (в случае многоплодной беременности — 84) календарных дней до родов и 70 (в случае осложненных родов — 86, при рождении двух или более детей — 110) календарных дней после родов с выплатой пособия.
Отпуск по беременности и родам исчисляется суммарно и предоставляется женщине полностью независимо от числа дней, фактически использованных ею до родов.
Факт беременности подтверждается на основании больничного листа. Его выдают на 30-й неделе беременности, а если женщина ждет двойню — на 28-й неделе.
По желанию беременной женщины до ухода в декретный отпуск ей может быть предоставлен ежегодный оплачиваемый отпуск. Продолжительность отпуска определяется пропорционально отработанному периоду. Такое право закреплено в статье 260 ТК РФ.
Перед отпуском по беременности и родам или непосредственно после него либо по окончании отпуска по уходу за ребенком женщине по ее желанию предоставляется ежегодный оплачиваемый отпуск независимо от стажа работы у данного работодателя.
Когда следует предупредить работодателя о беременности?
Чем раньше, тем лучше, если вы не хотите испортить отношения с работодателем. На любой работе требуется время, чтобы найти замену сотруднику, обучить нового работника и передать дела, контакты и другую рабочую информацию. Чем больше времени будет у работодателя подготовиться к вашему длительному отсутствию, тем комфортнее для всех пройдет процедура передачи вашего функционала.
В какой срок уходить в декретный отпуск, по закону или позднее (при условии хорошего самочувствия) решает только женщина — работодатель не имеет права отказать в предоставлении отпуска.
Некоторые беременные женщины остерегаются, что работодатель начнет их «обижать», а то и вовсе уволит. Законодательство на стороне беременных женщин, а нарушение норм и гарантий легко доказать.
