Имеет ли право работодатель требовать от работника приходить пораньше, за 15 минут до начала рабочего дня, а уходить позже на 15 минут? Это время требуется, чтобы сначала подготовить рабочее место, а потом его убрать и подготовить отчет о работе за день.
На каждом предприятии есть правила внутреннего распорядка, которые регламентируют права и обязанности работодателя и работников, включая время работы и отдых. Работники должны знать время начала и окончания работы, а также длительность обеда и других перерывов.
Тоже самое у вас должно быть прописано в вашем трудовом договоре. Если в трудовом договоре не указан приход на работу до начала рабочего дня и не оговорены условия оплаты или компенсации этого времени, значит требования преждевременного прихода на работу не законны. Тоже самое касается и ухода с работы.
Если по правилам внутреннего распорядка ваше рабочее время начинается в 9:00, то на рабочем месте вы должны оказаться не позднее начала рабочего дня, то есть в 9:00.
И вы, и работодатель должны соблюдать условия трудового договора: вы не имеете права опаздывать, а работодатель не имеет права требовать от вас работать безвозмездно перерабатывать. 15 минут до начала и 15 минут после работы дают 30 минут переработки ежедневно. В Трудовом кодексе есть определение рабочего времени, которое прописывается в трудовом договоре. Время вне рабочего дня – это время отдыха от выполнения трудовых обязанностей.

Работник имеет право на:
- отдых, обеспечиваемый установлением нормальной продолжительности рабочего времени, предоставлением еженедельных выходных дней, нерабочих праздничных дней, оплачиваемых ежегодных отпусков;
Работник обязан:
- добросовестно исполнять свои трудовые обязанности, возложенные на него трудовым договором;
- соблюдать правила внутреннего трудового распорядка.
Подготовка рабочего места к работе, а также уборка рабочего места, подготовка отчетов и другие обязанности в конце рабочего дня — это часть трудовой функции работника. Эти обязанности должны осуществляться в течение рабочего дня или смены. Работодатель должен или изменить график работы, установив начало рабочего дня в соответствии с требованием прихода и ухода, либо оплачивать сверхурочную работу. Увеличивать продолжительность рабочего дня на не рекомендуется, так как Трудовой кодекс также регламентирует длительность рабочего дня.

Работодатель имеет право:
- требовать от работников исполнения ими трудовых обязанностей, соблюдения правил внутреннего трудового распорядка.
Работодатель обязан:
- соблюдать трудовое законодательство и условия трудовых договоров;
- предоставлять работникам работу, обусловленную трудовым договором.
