Я был в командировке, а когда вернулся — узнал, что меня уволили. Я считаю, что увольнять работника в период командировки незаконно. Как можно защитить свои права?
Вы правы, в период командировки увольнение работника незаконно. Об этом говорит статья 167 Трудового кодекса.
При направлении работника в служебную командировку ему гарантируются сохранение места работы (должности) и среднего заработка, а также возмещение расходов, связанных со служебной командировкой.
Работодатель не может лишить работника гарантии, предусмотренной трудовым законодательством РФ безнаказанно. При нарушении своих прав работник имеет право пожаловаться в государственную инспекцию труда или обратиться в суд.
Однако, чтобы Трудовая инспекция была на стороне работника, направление в командировку должно быть правильно оформлено.
Служебная командировка — это поездка работника по распоряжению работодателя на определенный срок для выполнения служебного поручения вне места постоянной работы.
Самый главный документ, что работник не по собственной инициативе отсутствовал на работе, а отбыл в командировку по инициативе работодателя — это приказ работодателя. Любая командировка начинается с оформления приказа. Если в организации используются унифицированные формы, то это формы Т-9 (для одного командировочного) или Т-9а (для нескольких командировочных).
Командировочные удостоверения и служебные задания уже давно законодательно отменены, так что их наличие не обязательно.
Дополнительным подтверждением к приказу может быть выдача аванса на командировочные расходы. Аванс выдается работнику на основании приказа.
Командировка работника без приказа работодателя
Командировка будет признана официальной, если она возникла по инициативе работодателя и задокументирована приказом. Если же работник отправился в командировку по собственной инициативе, то такая командировка может бать признана нарушением работником трудового распорядка, а отсутствие работника на рабочем месте свыше четырех часов будет считаться отсутствием без уважительной причины и послужить основанием для увольнения.
