Мне установили испытательный срок при приеме на работу 6 месяцев. Законно ли это? Раньше у меня и у всех знакомых испытательный срок был всего 3 месяца.
Испытательный срок при приему на работу регулируется статьями 70 (длительность испытания) и 71 (результат испытания) Трудового кодекса.
Трудовой Кодекс РФ. Статья 70. Испытание при приеме на работу (оригинал документа):
Срок испытания не может превышать трех месяцев, а для руководителей организаций и их заместителей, главных бухгалтеров и их заместителей, руководителей филиалов, представительств или иных обособленных структурных подразделений организаций — шести месяцев.
При заключении трудового договора на срок от двух до шести месяцев испытание не может превышать двух недель.
В срок испытания не засчитываются период временной нетрудоспособности работника и другие периоды, когда он фактически отсутствовал на работе.
Вы не указали, на какую должность вас приняли. Если вы рядовой специалист, менеджер или даже руководитель отдела, то стандартный испытательный срок составляет 3 месяца.
И только на руководящие управленческие или бухгалтерские должности высшего звена устанавливается испытательный срок 6 месяцев, чтобы новый сотрудник смог проявить себя должным образом.
Обратите внимание, что для некоторых лиц испытательный срок не устанавливается. Например:
- беременные женщины и женщины с детьми до 1,5 лет
- лица, избранные по конкурсу или избранные на выборную должность
- лица, приглашенные на работу в порядке перевода
Может ли быть испытательный срок более 6 месяцев?
Теоретически может. Для этого должно совпасть два условия согласно 70 статье Трудового Кодекса.
- Работник должен быть принят на высшую руководящую или бухгалтерскую должность: руководителем организации (или руководителем филиала) или его заместителем, главным бухгалтером или его заместителем.
- Работник в период испытательного срока заболел или ушел в отпуск.
В этом случае дни отсутствия на работе могут быть прибавлены к испытательному сроку 6 месяцев.
