Моя жена официально не работает. Могу ли я как отец ребенка уйти вместо жены в декретный отпуск? Что для этого нужно сделать? Какие условия предоставления декретного отпуска отцам?
Да, законом предусмотрено оформление декретного отпуска на родственников: на отца ребенка, его бабушку или дедушку. Однако есть нюансы. Понятие «декретный отпуск» состоит из двух разных отпусков:
- отпуск по беременности и родам
- отпуск по уходу за ребенком до 1,5 — 3 лет
Отпуск по по беременности и родам регулируется 255 статьей Трудового Кодекса, а отпуск по уходу за ребенком регламентирует 256 статья ТК РФ.
Уйти в отпуск по беременности и родам может только беременная женщина. Будущему отцу ребенка уйти в отпуск по беременности вместо женщины невозможно по объективным причинам.
Так что законом отцу ребенка предоставляется только отпуск по уходу за ребенком. Этот отпуск может оформить любой родственник, который будет ухаживать за младенцем.

По заявлению женщины ей предоставляется отпуск по уходу за ребенком до достижения им возраста трех лет. Порядок и сроки выплаты пособия по социальному страхованию в период указанного отпуска определяются федеральными законами.
Отпуска по уходу за ребенком могут быть использованы полностью или по частям также отцом ребенка, бабушкой, дедом, другим родственником или опекуном, фактически осуществляющим уход за ребенком.На период отпуска по уходу за ребенком за работником сохраняется место работы (должность).
Законом запрещено одновременное нахождение двух человек в отпуске по уходу за одним и тем же ребенком, поэтому работающей матери нужно отказаться от своего права на отпуск. Если женщина работает, такая справка оформляется в бухгалтерии по месту работы матери ребенка.
Если мать ребенка официально не работает, то ей нужно получить справку в органе соцзащиты по месту жительства (месту пребывания) о том, что она не получает пособие по уходу за ребенком.
Отец ребенка по месту своей работы пишет заявление о предоставлении отпуска по уходу за ребенком и выплате соответствующего пособия. К заявлению он прикладывает свидетельство о рождении ребенка, а также справку о том, что работающая супруга не воспользовалась своим правом на отпуск по уходу за ребенком, а неработающая супруга не получает пособие.
Чтобы оформить оформить отпуск по уходу за ребенком на бабушку или дедушку, и мать, и отец ребенка должны подготовить справки о неиспользовании отпуска.
После предоставления всех документов работодатель не вправе отказать в предоставлении отпуска по уходу за ребенком с даты, указанной в заявлении.
