Может ли работодатель устанавливать премию больше, чем оклад? Может ли оклад быть меньше МРОТ?
Законодательством не запрещено устанавливать небольшой оклад и большую премию, чтобы стимулировать работников выполнять планы и задания в соответствии с их должностными инструкциями. Трудовой Кодекс никак не ограничивает размер премий.
Оклад — это фиксированный размер оплаты труда работника за исполнение должностных обязанностей за календарный месяц без учета компенсационных, стимулирующих и социальных выплат. Оклад — это та сумма, которую работник получит в любом случае.
Премия — это переменная часть заработной платы, ее выплачивают за достижение определенных результатов. Никаких ограничений для установления правил премирования Трудовой Кодекс не содержит. Размер премии сотрудникам определяется Положением о премировании, установленным у конкретного работодателя. Величина премиальных выплат может зависеть от различных факторов и рассчитываться различными способами.
Ограничения максимального размера премии устанавливаются только для руководителей, их замов и главбухов госучреждений федерального, регионального и муниципального уровней (статья 145 ТК РФ).
Условия оплаты труда конкретизируются в трудовых договорах с сотрудниками. Положение о премировании и/или трудовой договор должны определять виды премий, их размер (или порядок его определения), периодичность и сроки выплаты, критерии премирования (за что и при каких условиях выплачивается премия), основания лишения или уменьшения размера премий.
При выполнении работником критериев премирования работодатель обязан выплатить премию.

Заработная плата работнику устанавливается трудовым договором в соответствии с действующими у данного работодателя системами оплаты труда.
Системы оплаты труда, включая размеры тарифных ставок, окладов, системы доплат и надбавок стимулирующего характера и системы премирования, устанавливаются коллективными договорами, соглашениями, локальными нормативными актами в соответствии с трудовым законодательством.
Условия оплаты труда, определенные трудовым договором, не могут быть ухудшены по сравнению с установленными трудовым законодательством.
Может ли оклад быть меньше МРОТ?
Да, оклад может быть меньше МРОТ, а вот зарплата не может быть меньше МРОТ.
Зарплата состоит из нескольких частей (статья 129 Трудового Кодекса):
- фиксированный оклад
- доплаты за особые условия труда
- стимулирующие выплаты (премии)
Таким образом, если оклад вместе с ежемесячной премией дают итоговую сумму зарплаты больше МРОТ, то работодатель не нарушает законодательство,
Если же ежемесячная премия по каким-то причинам не выплачивалась работнику в конкретном месяце, и эта ситуация привела к тому, что работник за месяц получил зарплату меньше МРОТ, то работодатель должен произвести сотруднику доплату до МРОТ. Если же работодатель этого не сделает, то тем самым он нарушит трудовое законодательство. В этом случае он будет подвергнут финансовой и административной ответственности.
