При приеме на работу мне обещали хорошую зарплату. По факту — оклад маленький, а премии работники часто лишаются. Причины разные — то план не выполнили, то прибыль не получили. Имеет ли право работодатель лишать работника премии?
Да, работодатель может не премировать работника в случае невыполнения работником порученного ему задания, входящего в его должностные обязанности.
Зарплата состоит из нескольких частей (статья 129 Трудового Кодекса):
- фиксированный оклад
- доплаты за особые условия труда
- стимулирующие выплаты (премии)
Оклад — это фиксированный размер оплаты труда работника за исполнение должностных обязанностей за календарный месяц без учета компенсационных, стимулирующих и социальных выплат. Оклад — это та сумма, которую работник получит в любом случае.
Премия — это переменная часть заработной платы, ее выплачивают за достижение определенных результатов. Размер премии сотрудникам определяется Положением о премировании, установленным у конкретного работодателя. Никаких ограничений для установления правил премирования Трудовой Кодекс не содержит. Величина премиальных выплат может зависеть от различных факторов и рассчитываться различными способами.
Условия оплаты труда конкретизируются в трудовых договорах с сотрудниками. Положение о премировании и/или трудовой договор должны определять виды премий, их размер (или порядок его определения), периодичность и сроки выплаты, критерии премирования (за что и при каких условиях выплачивается премия), основания лишения или уменьшения размера премий.
За что можно лишить работника премии?
- невыполнение плана / задания
- дисциплинарный проступок
- увольнение в период премирования
- не полностью отработанный период премирования
Если работник не выполнил план или не справился с заданием, то он не заработал право на премию. А при дисциплинарных проступках сотрудник именно лишается премии.
При выполнении работником критериев премирования работодатель обязан выплатить премию.
Могут ли лишить премии весь коллектив?
Да, у работодателя есть такое право. В положении о премировании должны быть определены критерии начисления премии. Например, при достижении определенных финансовых показателей сотрудникам выплачивается премия, а при убытках — не выплачивается.
Строго говоря, коллектив не лишается премии, а у коллектива не возникает права на получение премии.

Заработная плата работнику устанавливается трудовым договором в соответствии с действующими у данного работодателя системами оплаты труда.
Системы оплаты труда, включая размеры тарифных ставок, окладов, системы доплат и надбавок стимулирующего характера и системы премирования, устанавливаются коллективными договорами, соглашениями, локальными нормативными актами в соответствии с трудовым законодательством.
Условия оплаты труда, определенные трудовым договором, не могут быть ухудшены по сравнению с установленными трудовым законодательством.
