Я работаю и одновременно получаю высшее образование. Мой начальник на работе отказывается давать мне очередной ежегодный отпуск. Говорит, я итак много отдыхаю от работы, пока сессию сдаю. Разве можно учебный отпуск заменить на ежегодный?
Ваш работодатель не имеет права лишать вас ежегодного оплачиваемого отпуска. По закону всем работникам полагаются ежегодные отпуска с сохранением места работы и среднего заработка. Также обязанностью работодателя является предоставление учебного отпуска в случаях, предусмотренных Трудовым кодексом. Предоставляется учебный отпуск на основании выданной учебным заведением справки-вызова по тем датам, которые в ней указанны.
Согласно статьям 173, 173.1 и статье 177 ТК РФ работодатель обязан предоставить дополнительные отпуска с сохранением среднего заработка работнику, совмещающему работу с обучением и впервые получающим образование соответствующего уровня.
Работникам, направленным на обучение работодателем или поступившим самостоятельно на обучение по программам бакалавриата, специалитета или магистратуры по заочной и очно-заочной формам обучения работодатель предоставляет дополнительные отпуска с сохранением среднего заработка для:
- прохождения аттестации на первом и втором курсах — по 40 дней,
- на каждом из последующих курсов — по 50 дней;
- прохождения государственной итоговой аттестации — до четырех месяцев.

Это означает, что работнику предоставляется и ежегодный отпуск, и учебный отпуск. Два отпуска одновременно предоставлены работнику быть не могут. При совпадении учебного отпуска с ежегодным отпуском, ежегодный отпуск переносится на другую дату либо учебный отпуск может быть присоединен к ежегодному отпуску.
Обратите внимание, что не во всех случаях работодатель обязан предоставлять дополнительный ученический отпуск работнику.
