Когда должны выдавать аванс и основную часть зарплаты? Какие конкретно сроки? Может ли работодатель не делить зарплату и аванс, а выплачивать все сразу? Это законно, или противоречит закону?
Законодательством запрещено выплачивать заработную плату один раз в месяц целиком, не деля ее на аванс и основную часть. Выплата зарплаты должна быть два раза в месяц или даже чаще, соответствующая норма содержится в Трудовом кодексе.

Заработная плата выплачивается не реже чем каждые полмесяца. Конкретная дата выплаты заработной платы устанавливается правилами внутреннего трудового распорядка или трудовым договором не позднее 15 календарных дней со дня окончания периода, за который она начислена.
При совпадении дня выплаты с выходным или нерабочим праздничным днем выплата заработной платы производится накануне этого дня.
Оплата отпуска производится не позднее чем за три дня до его начала.
Законом рабочий месяц поделен на две половины с точки зрения выплаты заработной платы. После отработки первой половины месяца (первых 15 дней) выплачивается первая часть зарплаты, или аванс. Срок выдачи аванса должен быть с 16 по 30 (31) число текущего месяца. После отработки второй половины месяца выплачивается оставшаяся часть суммы. Срок окончательного расчета должен быть не позднее 15 числа следующего месяца.
Что будет, если платить зарплату один раз в месяц
Работодатель может быть оштрафован за нарушение трудового законодательства. Несоблюдение требования о превышении количества дней между выплатами первой и второй части зарплаты может быть основанием для наложения штрафа сотрудниками Трудовой инспекции в рамках плановой проверки организации или по жалобе сотрудника.

Невыплата или неполная выплата в установленный срок заработной платы влечет предупреждение или наложение административного штрафа:
- на должностных лиц в размере от 10 тыс. до 20 тыс. рублей;
- на индивидуальных предпринимателей — от 1 тыс. до 5 тыс. рублей;
- на юридических лиц — от 30 тыс. до 50 тыс. рублей.
