На нашем предприятии многим понизили зарплату. Например, мне понизили зарплату на 20 %. Просто поставили перед фактом. Причина — кризис, предприятие терпит убытки. Законно ли такое действие работодателя?
Работодатель имеет право в одностороннем порядке изменить условия трудового договора (в том числе размер зарплаты) только в исключительных случаях. Если прежние условия труда не могут быть сохранены из-за изменения организационных или технологических условий труда.
В остальных случаях изменение условий трудового договора возможно только по соглашению сторон, выраженному в письменной форме. Это означает, что работодатель не может в одностороннем порядке понизить заработную плату из-за финансовых трудностей и убытков.
Кроме того, даже по причине организационных изменений работодатель не может понизить зарплату «по факту». Он обязан предупредить о подобном изменении за два месяца, и только после этого может изменить условия труда в одностороннем порядке. Порядок действий регламентирован статьей 74 ТК РФ,
Если по причинам изменения организационных или технологических условий труда (изменения в технике и технологии производства, структурная реорганизация производства) условия трудового договора не могут быть сохранены, допускается их изменение по инициативе работодателя, за исключением изменения трудовой функции работника.
О предстоящих изменениях условий трудового договора, а также о причинах, вызвавших необходимость таких изменений, работодатель обязан уведомить работника в письменной форме не позднее чем за два месяца.
Если работник не согласен работать в новых условиях, то работодатель обязан предложить ему другую работу, которую работник может выполнять с учетом его состояния здоровья.
При отсутствии указанной работы или отказе работника от предложенной работы трудовой договор прекращается.
Если работник принял решение уволиться, то статьи 77 и 178 ТК РФ регламентируют размер выходного пособия: это двухнедельный средний заработок.
Выходное пособие в размере двухнедельного среднего заработка выплачивается работнику при расторжении трудового договора в связи с:
отказом работника от продолжения работы из-за изменения определенных сторонами условий трудового договора
