Уже полгода мы работаем без начальника отдела. Меня, как заместителя, обязали исполнять его обязанности. Моего согласия никто не спрашивал. Время идет, а меня и в должности не повышают, и работаю как белка в колесе, очень устала. Законны ли требования директора?
В большинстве случаев работник имеет право отказаться от выполнения работы по совмещению, так как Трудовой кодекс РФ предусматривает совмещение профессий только с письменного согласия работника и только за дополнительную плату.
Однако ваша ситуация не попадает под общую практику. Если работник является заместителем отсутствующего работника и соответствующие обязанности прописаны в его трудовом договоре и должностной инструкции, то требование выполнения этих обязанностей не нуждается в согласии работника. Подписав трудовой договор, вы, как заместитель, уже дали письменное согласие исполнять обязанности временно отсутствующего руководителя.
С письменного согласия работника ему может быть поручено выполнение наряду с работой, определенной трудовым договором, дополнительной работы по другой или такой же профессии (должности) за дополнительную оплату.
Для исполнения обязанностей временно отсутствующего работника без освобождения от работы по трудовому договору, работнику может быть поручена дополнительная работа как по другой, так и по такой же профессии (должности).
При совмещении профессий (должностей) без освобождения от работы, определенной трудовым договором, работнику производится доплата. Иначе говоря, заставлять работников бесплатно совмещать две должности (две работы) — незаконно. Регулирует правила доплаты статья 151 Трудового кодекса.
При совмещении профессий (должностей) или исполнении обязанностей временно отсутствующего работника без освобождения от работы, определенной трудовым договором, работнику производится доплата.
Размер доплаты устанавливается по соглашению сторон трудового договора с учетом содержания и (или) объема дополнительной работы.
Длительное время исполняя работу начальника отдела, вы можете потребовать доплату, соответствующую этим обязанностям и вашей ответственности.
