На нашей работе никогда не сокращают рабочее время накануне выходных (в пятницу) и накануне праздников. Работаем, как всегда. Это законно?
Работодатель действует по закону перед выходными и нарушает закон (и ваши права) перед праздничными днями. Трудовой Кодекс однозначно прописывает, что продолжительность рабочего дня или смены, непосредственно предшествующих нерабочему праздничному дню, уменьшается на один час.

В непрерывно действующих организациях и на отдельных видах работ, где невозможно уменьшение продолжительности работы (смены) в предпраздничный день, переработка компенсируется предоставлением работнику дополнительного времени отдыха или, с согласия работника, оплатой по нормам для сверхурочной работы.
Накануне выходных дней продолжительность работы при шестидневной рабочей неделе не может превышать пяти часов.
Иными словами, всем работникам гарантируется сокращение рабочего времени на один час перед праздниками. Тем же работникам, которые не могут воспользоваться сокращенным рабочим днем, полагается компенсация.
Обратите внимание, что сокращение рабочего времени законом предусмотрено не перед всеми праздничными днями, а только перед нерабочими праздничными днями, так как в нашей стране есть еще и рабочие праздничные дни.
Перечень нерабочих праздничных дней приведен в статье 112 ТК РФ.

Нерабочими праздничными днями в Российской Федерации являются:
1, 2, 3, 4, 5, 6 и 8 января — Новогодние каникулы;
7 января — Рождество Христово;
23 февраля — День защитника Отечества;
8 марта — Международный женский день;
1 мая — Праздник Весны и Труда;
9 мая — День Победы;
12 июня — День России;
4 ноября — День народного единства.При совпадении выходного и нерабочего праздничного дней выходной день переносится на следующий после праздничного рабочий день, за исключением выходных дней, совпадающих с нерабочими праздничными днями.
В целях рационального использования работниками выходных и нерабочих праздничных дней выходные дни могут переноситься на другие дни.
Продолжительность работы накануне выходных
Сокращение рабочего времени на один час перед выходными законом не предусматривается. Сократить рабочий день на один час в пятницу — это инициатива работодателя, которая улучшает положение работников.
Еще один вариант, который может практиковаться в некоторых организациях. В правилах внутреннего трудового распорядка предусмотрен режим работы: обеденный перерыв длится 48 минут, а не час. За счет сэкономленных 12 минут от каждого часа, которые за 5 дней набегают в 60 минут, и получается один час, на который сокращается пятница.
Резюме: если работодатель не предоставляет вам сокращенный рабочий день перед праздниками, а также не предоставляет компенсации за работу в этот час, то такое требование не правомерно.
