Я нашла недорогую квартиру с обременением в виде «отказника от приватизации». Продавец обещает, что все выпишутся после продажи. Что это означает и какие для меня риски?
Обременения — это ограничения прав собственника в пользу третьих лиц. Обременения возникают по договору ипотеки, договору ренты, договору аренды, в результате отказа прописанного в квартире от приватизации, ареста или банкротства собственника.
Обременения на квартиру из-за отказа от приватизации
Приватизация — это процедура перевода государственного жилья в частное, в котором люди живут по договору социального найма. Граждане России имеют право приватизировать квартиры / дома и получить свою долю собственности. Иногда проживающий в квартире человек отказывается от своей доли в приватизации квартиры в пользу проживающих там же других жильцов. Так как «отказнику» где-то надо жить, то в качестве компенсации по Закону о приватизации он получает безусловное право пожизненного проживания в этой квартире.
Обременение квартиры в виде отказавшегося от приватизации — это безвозмездное и пожизненное пользование квартирой человеком, который отказался от участия в ее приватизации.
Важно! Информация о безвозмездном пользовании квартирой отказавшимися от ее приватизации не отражается ни в свидетельстве о праве собственности, ни в выписке ЕГРН.
Можно ли принудительно выписать отказавшегося от приватизации?
Нельзя! Если он не выпишется сам добровольно, то у вас есть два варианта:
- Жить с ним в купленной квартире до его смерти
- Купить ему другую квартиру и договориться об отселении
Совет покупателю квартиры: лучше откажитесь от покупки! Если все же решитесь купить — квартира с обременением в виде пожизненного проживания дешевле аналогов в 2 раза.
Бывает, что люди покупали квартиру и уже после выясняли, что посторонний человек имеет право безвозмездного пользования их квартирой, и лишить его этого права невозможно.
Как проверить обременение?
Нужно запросить выписку из домовой книги или единый жилищный документ (ЕЖД). В этих документах указано, кто в квартире зарегистрирован по месту жительства и сохраняют ли эти люди в соответствии с законом право проживания в квартире при её продаже.
Если есть договоренность с отказавшимися от приватизации
Если есть договоренность — то вам необходимо получить от отказавшегося от приватизации нотариальное заявление, что он согласен с условиями приватизации и согласен с продажей квартиры. Самое безрисковое решение — чтобы он снялся с регистрационного учета и зарегистрировался по новому месту жительства до покупки квартиры.
