Уже прошло две недели после увольнения, а я до сих пор не получила трудовую книжку и справки. Что можно сделать в этой ситуации?
Существует единый порядок оформления расторжения трудового договора вне зависимости от инициатора увольнения и оснований для прекращения работы. Увольнение по трудовому договору без выдачи трудовой книжки и окончательного расчета законом не допускается. Порядок действий регламентирован статьей 84.1. ТК РФ.
Прекращение трудового договора оформляется приказом работодателя.
Днем прекращения трудового договора является последний день работы работника.
В день прекращения трудового договора работодатель обязан выдать трудовую книжку или предоставить сведения о трудовой деятельности и произвести расчет.
По письменному заявлению работника работодатель также обязан выдать ему заверенные копии документов, связанных с работой.
По письменному обращению работника, не получившего трудовой книжки после увольнения, работодатель обязан выдать ее не позднее трех рабочих дней со дня обращения работника.
По закону работодатель обязан выдать работнику трудовую книжку в его последний рабочий день. А в случае, если работодатель «забыл» ее выдать, то законом дается еще 3 дня с момента обращения работника.
Ответственность за невыдачу трудовой книжки
Задержка выдачи трудовой книжки и иных документов при увольнении — грубое нарушение прав работника. Работодатель будет подвергнут штрафу до 50 000 рублей (статья 5.27 Кодекса об административных правонарушениях), а также должен произвести выплаты непосредственно в пользу работника. Статья 234 ТК РФ обязывает работодателя выплатить компенсацию за невыдачу трудовой книжки.
Работодатель обязан возместить работнику не полученный им заработок во всех случаях незаконного лишения его возможности трудиться. Такая обязанность, в частности, наступает, если заработок не получен в результате:
- задержки работодателем выдачи работнику трудовой книжки, предоставления сведений о трудовой деятельности,
- внесения в трудовую книжку, в сведения о трудовой деятельности неправильной или не соответствующей законодательству формулировки причины увольнения работника.
