Наша семья имеет временную регистрацию в Москве. Ребенок тоже. В детском садике отказываются брать нашего ребенка по причине отсутствия постоянной прописки. Говорят, что приоритет для детей с постоянной пропиской, а дети по временной регистрации — после, если останутся места. Это законно?
Вам отказывают в приеме ребенка в детский сад незаконно. В теории согласно Конституции РФ у всех граждан РФ есть право на бесплатное образование в школах и детских садах.
На практике при приеме пакета документов в дошкольные учреждения имеет значение только адрес места регистрации. Логично, что чем ближе адрес места регистрации ребенка к адресу детского сада — тем меньше оснований не принять ребенка в детский сад. А с точки зрения закона постоянная (по месту жительства) или временная регистрация (по месту пребывания) по этому адресу — это не важно, они равнозначны по силе.
Чтобы ребенка поставили в очередь в детский сад, нужно подать заявление. Прием документов в дошкольные учреждения осуществляется напрямую в детский сад или через МФЦ, лично или через интернет. В МФЦ вы можете встать в очередь сразу в несколько детских садов. В заявлении можно указать номера ближайших детских садов. Но если там мест не окажется, должны предложить еще варианты. Отказать в приеме документов вам не имеют права.
Отказ из детского сада возможен в том случае, если там нет мест.
Приоритетом пользуются только лица, обладающие льготами: например, многодетные семьи, матери-одиночки, военнослужащие.
Если вам все же отказали, должна быть указана причина. Если вы не согласны с причиной отказа, то попробуйте написать жалобу в отдел образования муниципалитета по месту нахождения детского сада. Также можно потребовать оформления ребенка с временной регистрацией в детский сад через суд.
