Мне не разрешили болеть дома без больничного. А я не захотела оформлять больничный, ведь это на неделю. Пришлось больной ходить на работу. На предыдущей работе можно было отсутствовать на работе по болезни без больничного 3 дня. Ведь был такой закон. Мои права нарушили?
Можно отсутствовать на работе по причине болезни три дня без больничного — действительно, был такой закон «Основы законодательства РФ об охране здоровья граждан» от 1993 года. Статья 20 этого закона звучала так:
«Работающие граждане в случае болезни имеют право на три дня неоплачиваемого отпуска в течение года, который предоставляется по личному заявлению гражданина без предъявления медицинского документа, удостоверяющего факт заболевания».
По закону работнику достаточно было предупредить руководителя о своей болезни, не предъявляя никаких документов, и такое отсутствие не считалось прогулом. К сожалению, эта норма утратила силу в еще 2004 году. В настоящее время отсутствие на работе по болезни без официального листка нетрудоспособности Трудовым кодексом не предусмотрено.
Право на три дня отсутствия по болезни
Однако Трудовой кодекс не запрещает руководству организаций предоставлять условия труда работникам лучше, чем это прописано в Трудовом кодексе. Поэтому в некоторых компаниях работникам в составе соцпакета может предоставляться право на три дня отсутствия на работе по болезни без предоставления медицинского документа. Если в течение года работник не реализовал свое право, то эти три дня прибавляются к ежегодному отпуску.
Вам следует уточнить в своей организации правила и условия оформления в случае отсутствия на рабочем месте по болезни. И конечно всегда предупреждать своего руководителя о планируемом отсутствии на работе, сначала по телефону, а задним числом оформить заявление. Тогда отсутствие не будет считаться прогулом и даже будет оплачиваться.

Если без больничного не обойтись
Если в компании не существует возможности болеть без официального больничного (листка нетрудоспособности), то работодатель может пойти работнику навстречу. Работник может оформить эти дни в счет оплачиваемого отпуска или взять отпуск до трех дней за свой счет. Возможно, у работника накопились отгулы, тогда можно взять отгул. Для этого нужно написать соответствующее заявление, а руководитель ставит на нем свою визу.
Обязательно следует согласовать с руководством невыход на работу и получить разрешение. В противном случае можно получить дисциплинарное взыскание вплоть до увольнения. По Трудовому Кодексу прогулом считается отсутствие на рабочем месте без уважительной причины свыше 4 часов.
Трудовой договор может быть расторгнут работодателем в случаях:
- прогула, то есть отсутствия на рабочем месте без уважительных причин в течение всего рабочего дня (смены), а также в случае отсутствия на рабочем месте без уважительных причин более четырех часов подряд в течение рабочего дня (смены).
