Я беременна. На работе тяжелая атмосфера. Начальство угрожает увольнением по любому поводу, а еще настаивает, чтобы я написала заявление по собственному желанию. Хотят сэкономить на положенных мне выплатах и гарантиях.
Увольнение женщины во время беременности запрещено! Трудовое законодательство разрешает только две ситуации, когда возможно увольнение беременной женщины по инициативе работодателя:
- ликвидация организации
- временное исполнение обязанностей отсутствующего работника
Расторжение трудового договора по инициативе работодателя с беременной женщиной не допускается, за исключением случаев ликвидации организации либо прекращения деятельности индивидуальным предпринимателем.
Допускается увольнение женщины в связи с истечением срока трудового договора в период ее беременности, если трудовой договор был заключен на время исполнения обязанностей отсутствующего работника.
Увольнение беременной женщины при ликвидации организации
Увольнение беременной работницы при ликвидации организации регламентировано статьей 180 ТК РФ.
О предстоящем увольнении в связи с ликвидацией организации, сокращением численности или штата работников организации работники предупреждаются работодателем персонально и под роспись не менее чем за два месяца до увольнения.
Работодатель с письменного согласия работника имеет право расторгнуть с ним трудовой договор до истечения срока, выплатив ему дополнительную компенсацию в размере среднего заработка работника, исчисленного пропорционально времени, оставшемуся до истечения срока предупреждения об увольнении.
Корме того, всем сотрудникам, включая беременных женщин, полагается получение компенсационных выплат в размере минимум 2 оклада (статья 178 ТК РФ).
Увольнение беременной женщины, если она временно исполняет обязанности
В случае исполнения беременной женщиной обязанностей временно отсутствующего сотрудника, работодатель обязан предложить беременной работнице все вакансии, подходящие ей по состоянию здоровья и находящиеся в данной местности, включая как соответствующие её квалификации должности, так и нижестоящие (менее оплачиваемые).
Если (с письменного согласия женщины) невозможно перевести ее до окончания беременности на другую имеющуюся у работодателя работу, то в этом случае допускается её увольнение.
Увольнение беременной женщины, если закончился ее трудовой договор
Запрещено! Работодатель обязан продлить трудовой договор до рождения ребенка с предоставлением отпуска по беременности и родам.
Увольнение беременной женщины по собственному желанию
Беременная женщина может уволиться по собственному желанию. Но какая беременная согласится на такой необдуманный шаг, чтобы лишиться всех гарантий и пособий? Если руководство компании давит на женщину и заставляет ее уволиться по собственному желанию — это грубое нарушение ее прав. Принуждение к увольнению — это нарушение норм трудового законодательства.
Увольнение женщины по причине беременности незаконно.
Законодательство стоит на защите интересов беременных женщин, включая условия труда в то время, когда женщина в положении.
Запрещается направлять беременных в командировки или заставлять работать в нерабочее время. Запрещено уволить беременную женщину за прогул.
Если женщина предъявила работодателю правильно оформленный документ о своей беременности, то с этого момента работодатель должен учитывать ее положение и действовать по отношению к ней в рамках закона. Беременную женщину нельзя уволить.
