Я учусь в магистратуре и работаю. Полагается ли мне учебный отпуск в дополнение к ежегодному? Работодатель считает, что мне не положено, так как я получаю второе высшее.
Давайте разберемся, какое обучение считается вторым высшим образованием. Предположим, вы закончили бакалавриат, получили квалификацию дипломированного специалиста, а потом, допустим, разочаровались в выбранной профессии и решили учиться опять по другой программе бакалавриата в этом или другом ВУЗе.
В России высшее образование разделено на 3 уровня:
- Бакалавриат. Срок обучения — 4 года. Студенты получают базовое образование по выбранному направлению.
- Магистратура. Срок обучения — 2 года. Студенты изучают узкие дисциплины по специальности.
- Подготовка кадров высшей квалификации: аспирантура, ординатура и т. д.
Бакалавриат — это полное высшее образование определенного уровня. Высшее образование подразумевает освоение образовательной программы ВУЗа и подтверждается соответствующим дипломом.
Возвращаемся к нашему гипотетическому примеру. Если вы решили повторно получать квалификацию дипломированного специалиста по программе бакалавриата, то это будет считаться вторым высшем образованием. Два диплома по программам бакалавриата = два высших образования.
Если же вы решили продолжить обучение по программе магистратуры, то с точки зрения Трудового кодекса такое образование не считается вторым высшим. Оно считается первым по программе следующего уровня. Если же вы захотите получить еще один диплом по магистерской программе, то у вас будет два диплома магистра и два высших образования по программам соответствующего уровня.
Согласно статьям 173, 173.1 и статье 177 ТК РФ работодатель обязан предоставить дополнительные ученические отпуска с сохранением среднего заработка работнику, совмещающему работу с обучением и впервые получающим образование соответствующего уровня.
1. Гарантии и компенсации работникам, совмещающим работу с получением образования, предоставляются при получении образования соответствующего уровня впервые.
2. Указанные гарантии также могут предоставляться работникам, уже имеющим образование соответствующего уровня и направленным для получения образования работодателем в соответствии с трудовым или ученическим договором, заключенным между работником и работодателем в письменной форме.
Обратите внимание, что при получении обучения впервые работодатель обязан предоставить работнику и ежегодный отпуск, и учебный отпуск.
При обучении соответствующего уровня повторно работодатель не обязан, но может добровольно предоставлять учебный отпуск при условии заключения такого договора между работником и работодателем.
