Я нахожусь в декретном отпуске. Ребенку скоро полтора года. Я предупредила руководителя, что планирую выйти на работу. Мне сказали, что я могу выйти только на другую должность с зарплатой ниже, чем было. Моя должность уже занята. Это законно?
Не законно. Женщине после декретного отпуска гарантируется та же должность и зарплата, которые у нее были до ухода в декретный отпуск.

По заявлению женщины ей предоставляется отпуск по уходу за ребенком до достижения им возраста трех лет. Порядок и сроки выплаты пособия в период указанного отпуска определяются федеральными законами.
На период отпуска по уходу за ребенком за работником сохраняется место работы (должность).
Условия трудового договора после выхода из декретного отпуска должны остаться теми же, как и до ухода в декрет. Поэтому работодатель не имеет права не только менять должность, но и уменьшать зарплату.
Скорее всего, женщина должна получать даже больше, чем до декрета. Если в организации ежегодно происходит индексация окладов с учетом инфляции или по другим причинам, то размер ее оклада будет индексироваться в общем порядке.
Кроме того, зарплата на руки у родителей после рождения ребенка становится немного больше за счет налогового вычета на детей.
