Я уволился, но так и не получил полный расчет. Похоже, работодатель и не собирается выплачивать мне мои деньги. Хочу обратиться в Трудовую инспекцию. Как правильно это сделать?
Трудовой Кодекс стоит на защите интересов работника. Согласно ТК РФ работодатель не имеет права задерживать зарплату работающему работнику. Если же работник увольняется, ТК РФ также регламентирует выплату всех причитающихся работнику денег — расчет положен в день увольнения. Такое правило закреплено в 140 статье Трудового Кодекса.

При прекращении трудового договора выплата всех сумм, причитающихся работнику от работодателя, производится в день увольнения работника.
Если работник в день увольнения не работал, то суммы должны быть выплачены не позднее следующего дня после предъявления уволенным работником требования о расчете.
В случае спора о размерах сумм, причитающихся работнику при увольнении, работодатель обязан в указанный срок выплатить не оспариваемую им сумму.
При увольнении работнику полагается:
- Остаток зарплаты за отработанное время.
- Выплата премий, бонусов, надбавок и доплат.
- Компенсация за неиспользованный отпуск.

При задержке заработной платы или задержке расчета при увольнении работник может обратиться за защитой своих прав в территориальный орган Роструда – государственную инспекцию труда (ГИТ). Заявление пишется в произвольной форме с изложением всех фактов и подкрепляется подтверждающими документами.
Заявление может быть передано:
- лично в территориальное отделение ГИТ
- заказным письмом с уведомлением
- в электронном виде на сайте госуслуг
- в электронном виде на портале территориального отделения ГИТ
Самым простым способом подачи заявления является подача заявления на официальном сайте Федеральной службы по труду и занятости через систему онлайнинспеция.рф. Поступившее заявление рассматривается не более 30 дней (статья 12 Закона № 59-ФЗ). За это время проводится внеплановая проверка работодателя и в случае выявления нарушений составляется акт, а также выносится предписание работодателю.
