При заключении трудового договора мой паспорт был на замене. Так что договор оформлен без моих паспортных данных. Я беспокоюсь, считается ли мой трудовой договор действительным?
Паспортные данные работника являются обязательными реквизитами стороны для заключения трудового договора. Однако вы можете не беспокоиться. Даже если в вашем трудовом договоре не указаны ваши паспортные данные, то договор все равно считается заключенным. Вам необходимо дополнить ваш трудовой договор сведениями о паспортных данных. Для этого достаточно внести требуемые сведения непосредственно в текст трудового договора.

В трудовом договоре указываются:
- фамилия, имя, отчество работника и наименование работодателя, заключивших трудовой договор;
- сведения о документах, удостоверяющих личность работника.
Если при заключении трудового договора в него не были включены какие-либо сведения или условия, то это не является основанием для признания трудового договора незаключенным.
Трудовой договор должен быть дополнен недостающими сведениями или условиями. Недостающие сведения вносятся непосредственно в текст трудового договора, а недостающие условия определяются приложением к трудовому договору.
Если ваши трудовые права нарушаются, то вы можете пожаловаться в Государственную инспекцию труда самостоятельно или с помощью консультантов.
