Мой знакомый просит меня выступить поручителем по его кредиту. Говорит, что это просто формальность. А он сможет получить сумму кредита в 2 раза больше. Чем мне это грозит, если он не вернет кредит в срок?
Поручительство по кредиту — это юридическая ответственность и финансовый риск, которые многие почему-то считают просто формальностью. Поручаясь за другого человека и подписывая договор поручительства по кредитному договору, вы обязуетесь выплатить него долг (тело кредита), проценты по кредиту и штрафы в случае, если ваш знакомый прекратит исполнять свои обязательства по данному кредитному договору.
Ответственность поручителя перед кредитором регулируется Гражданским Кодексом РФ.
ГК РФ. Статья 363. Ответственность поручителя (оригинал документа)
1. При неисполнении должником обязательства поручитель и должник отвечают перед кредитором солидарно или субсидиарно.
2. Поручитель отвечает перед кредитором в том же объеме, как и должник, включая уплату процентов, возмещение судебных издержек по взысканию долга и других убытков кредитора из-за неисполнения обязательства должником.
Что дает привлечение поручителя?
Привлекая платежеспособного поручителя, заемщик получит в банке увеличенную сумму кредита за счет объединения доходов заемщика и поручителя. Банк получает дополнительную гарантию выплаты кредита.
Какие возникают риски для поручителя?
- финансовые (поручителю придется платить за заемщика)
- репутационные (плохая кредитная история)
Если поручителю потребуется самому получить кредит, то обязательства по поручительству будут учитываться банком при оценке кредитной нагрузки и могут заблокировать получение кредита.
Что делать, если заемщик отказался платить по кредиту?
Платить! Подписывая договор поручительства, все обязательства поручителя по кредитному договору заемщика (сумма кредита, сроки, процентные ставки) переходят к поручителю, если заемщик перестает платить. Если же поручитель не платит за заемщика, то банк начинает требовать своё, а все просрочки и неплатежи отражаются в кредитной истории поручителя.
Стоит ли становиться поручителем?
Если у вас есть сомнения в платежеспособности человека — отказывайте! «Дружба дружбой, а деньги врозь». Иначе придется выплачивать чужие долги.
Перед заключением договора потребуйте с заемщика документы о его доходах и возьмите у него расписку о компенсации ваших убытков по договору поручительства, если они будут иметь место в случае неплатежей заемщика. У поручителя есть не только обязанности, но и права, которые защищает Гражданский Кодекс.

К поручителю, исполнившему обязательство, переходят права кредитора, в том числе как залогодержателя. Поручитель также вправе требовать от должника уплаты процентов на сумму, выплаченную кредитору, и возмещения иных убытков.
Можно ли отказаться от договора поручительства?
В соответствии с договором поручительства дата окончания поручительства заканчивается вместе с действием кредитного договора. Отказаться в одностороннем порядке до срока истечения договора нельзя. Только по соглашению с банком и заемщиком.
Полное освобождение от ответственности поручителя наступает через три года после последнего платежа, если банк не направил иск в суд. По истечении трех лет наступает срок исковой давности.
