Мне много приходится работать сверхурочно. Иногда по 12 часов в день. Это тяжело. Обидно, что сверхурочная работа у нас не оплачивается. Якобы мы не успеваем все вовремя. Разве это законно? Как должна оплачиваться робота сверхурочно?
За сверхурочную работу должна производиться достойная оплата согласно трудового законодательства. Об этом прописано в 152 статье Трудового кодекса.

Сверхурочная работа оплачивается за первые два часа работы не менее чем в полуторном размере, за последующие часы — не менее чем в двойном размере.
По желанию работника сверхурочная работа вместо повышенной оплаты может компенсироваться предоставлением дополнительного времени отдыха, но не менее времени, отработанного сверхурочно.
Указанный размер оплаты сверхурочных работ считается минимальным. По желанию работодателя оплата за сверхурочный труд может быть увеличена сверх нормы.
В соответствии с Трудовым Кодексом нормальная продолжительность рабочего времени не может превышать 40 часов в неделю.
Рабочее время — время, в течение которого работник в соответствии с правилами внутреннего трудового распорядка и условиями трудового договора должен исполнять трудовые обязанности.

Работодатель обязан вести учет времени, фактически отработанного каждым работником.
Работа признается сверхурочной, если она выполняется по инициативе работодателя сверх установленной для работника нормы. Если же работник задерживается на работе по собственной инициативе, то такая работа не является внеурочной и не оплачивается.
Имейте в виду, что продолжительность сверхурочной работы не должна превышать для каждого работника 4 часов в течение двух дней подряд и 120 часов в год.
