У нас на работе регулярные переработки, так как людей не хватает. Руководство почти каждый день заставляет работать сверхурочно, угрожая штрафом или увольнением. Что мне делать, чтобы отказаться по закону?
Согласно Трудовому Кодексу нормальная продолжительность рабочего времени не может превышать 40 часов в неделю.
Рабочее время — время, в течение которого работник в соответствии с правилами внутреннего трудового распорядка и условиями трудового договора должен исполнять трудовые обязанности.

Работодатель обязан вести учет времени, фактически отработанного каждым работником.
Работа признается сверхурочной, если она выполняется по инициативе работодателя сверх установленной для работника нормы. Каждый час после конца рабочего дня должен быть учтен и оформлен как сверхурочный. Регулирует правила привлечения работников к сверхурочной работе статья 99 Трудового кодекса.
Работодатель может привлекать работников к сверхурочной работе без их согласия только при чрезвычайных ситуациях. В остальных случаях сверхурочная работа допустима только с письменного согласия работника.

Привлечение работника к сверхурочной работе допускается с его письменного согласия:
- при необходимости выполнить (закончить) начатую работу, которая по техническим условиям не могла быть выполнена, если невыполнение работы может повлечь порчу имущества работодателя, либо создать угрозу жизни и здоровью людей.
- для продолжения работы при неявке сменяющего работника, если работа не допускает перерыва.
Продолжительность сверхурочной работы не должна превышать для каждого работника 4 часов в течение двух дней подряд и 120 часов в год.
Если вы не давали письменного согласия, то работодатель не может вас привлечь к сверхурочной работе. Если же вы такое согласие давали, то работодателем должны соблюдаться трудовые нормы. Иначе говоря, на постоянной основе заставлять работников перерабатывать — незаконно.
Кроме того, недопустимо заставлять работать сверхурочно или сверхурочная работа должна с существенными ограничениями для лиц:
- беременные женщины
- лица до 18 лет
- инвалиды
- женщины с детьми до 3-х лет
За сверхурочную работу должна производиться достойная оплата согласно законодательства. Об этом прописано в 152 статье Трудового кодекса.
