Я беременна. Мой срочный трудовой договор истекает за два месяца до срока декретного отпуска. Могут ли меня уволить по срочному договору? Будут ли мне платить декретные пособия по уходу за ребенком?
Беременную женщину можно уволить после окончания срока действия договора только в том случае, если срочный трудовой договор с ней был заключен на время исполнения обязанностей отсутствующего работника. Временно отсутствующий работник вышел на работу, следовательно срок договора истек. В этой ситуации трудовым законодательством допускается увольнение беременной, но только после соблюдения ряда условий.
Что касается остальных случаев истечения срочного трудового договора, то работодатель должен поступить по регламенту:
В случае истечения срочного трудового договора в период беременности женщины работодатель обязан по ее письменному заявлению и при предоставлении медицинской справки, подтверждающей состояние беременности:
- продлить срок действия трудового договора до окончания беременности,
- а при предоставлении ей в установленном порядке отпуска по беременности и родам — до окончания такого отпуска.
Женщина, срок действия трудового договора с которой был продлен до окончания беременности, обязана по запросу работодателя (не чаще одного раза в три месяца) предоставлять медицинскую справку, подтверждающую состояние беременности.
Если при этом женщина фактически продолжает работать после окончания беременности, то работодатель имеет право расторгнуть трудовой договор с ней в связи с истечением срока его действия в течение недели со дня, когда работодатель узнал или должен был узнать о факте окончания беременности.
Иными словами, увольнение беременной женщины из-за окончания срочного трудового договора возможно после рождения ребенка и отпуска по беременности и родам.
Если женщина предъявила работодателю правильно оформленный документ о своей беременности, то с этого момента работодатель должен учитывать ее положение и действовать по отношению к ней в рамках закона. Беременную женщину нельзя уволить. Соответственно, женщине полагаются и все декретные выплаты.
